Terms of Service

These Terms of Service ("Terms") govern your access to and use of TempoGears ("Service"), operated by TempoGears ("we," "us," or "our"). By using the Service you agree to these Terms. If you do not agree, do not use the Service.

1. Description of Service

TempoGears provides a command-line interface (CLI) and backend API that allows digital marketing agencies and their authorized users to authenticate TikTok accounts via OAuth, schedule video posts, and manage posting queues across multiple TikTok accounts. The Service interacts with the TikTok for Developers API on behalf of users who have explicitly authorized such access.

2. TikTok Platform Integration

TempoGears uses the TikTok Content Posting API and related TikTok for Developers services. By using TempoGears you also agree to:

You authorize TempoGears to act as your agent when accessing the TikTok API on your behalf using OAuth tokens you have granted. You may revoke this authorization at any time by disconnecting the TempoGears application from your TikTok account settings or by running tg auth logout.

3. Eligibility

You must be at least 18 years old and have the legal authority to enter into these Terms, either individually or on behalf of a business entity you represent. If you are using the Service on behalf of an agency or business, you represent that you have the authority to bind that entity to these Terms.

4. Account and API Key Security

You are responsible for keeping your TempoGears API key and any TikTok OAuth credentials confidential. Do not share your API key. You are responsible for all activity that occurs under your account. Notify us immediately at hello@tempogears.com if you believe your credentials have been compromised.

By using the Service, you acknowledge that TempoGears stores OAuth access tokens and refresh tokens associated with TikTok accounts you connect. Tokens are encrypted at rest. We do not sell your data or TikTok account credentials to third parties.

TempoGears stores the minimum data necessary to operate the scheduling service, including: your email address, TikTok handles you have connected, scheduled post metadata (caption, time, status), and video files temporarily until they are posted. Video files are deleted from our storage after successful posting or upon your request.

You may request deletion of all data associated with your account by contacting hello@tempogears.com.

7. User Content

You retain ownership of all video content you upload or schedule through the Service. By using the Service, you grant TempoGears a limited, non-exclusive license to store and transmit your content solely for the purpose of fulfilling your scheduled posts on TikTok. We do not claim any ownership rights over your content.

8. Subscription and Billing

TempoGears offers free and paid subscription tiers. Paid subscriptions are billed monthly via Stripe. You may cancel at any time; cancellation takes effect at the end of the current billing period. We do not issue refunds for partial billing periods. We reserve the right to change pricing with 30 days' notice.

9. Service Availability

We strive to keep the Service available but do not guarantee uninterrupted access. Scheduled posts depend on connectivity to the TikTok API; if TikTok experiences downtime or rate-limits our requests, posts may be delayed. We are not liable for missed posting windows caused by third-party API unavailability.

10. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms, abuse of the TikTok API, non-payment, or any reason we deem necessary to protect the integrity of the platform. You may terminate your account at any time by contacting us. Upon termination, your data will be deleted within 30 days.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. TEMPOGEARS DOES NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE OR THAT SCHEDULED POSTS WILL ALWAYS BE PUBLISHED AT THE EXACT REQUESTED TIME.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TEMPOGEARS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE THREE MONTHS PRECEDING THE CLAIM.

13. Indemnification

You agree to indemnify and hold harmless TempoGears and its officers, employees, and agents from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights including TikTok's platform policies.

14. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or by displaying a notice in the Service. Continued use of the Service after changes take effect constitutes your acceptance of the updated Terms.

15. Governing Law

These Terms are governed by the laws of the State of Maryland, United States, without regard to its conflict of law provisions. Any disputes will be resolved in the state or federal courts located in Maryland.
